Domestic Assault
If
you are charged with domestic assault or simple assault, do not plead guilty,
consult with us. There may be defenses available to you that are technical and
an ordinary person is usually oblivious to them. Also, the allegations and the
evidence may be challenged under the Canadian Charter of Rights and
Freedoms and this can result in a successful conclusion to your
case.
Drinking and Driving
If you are charged with an offence such as “impaired driving” or
“over 80” seek our advice before taking the next step. A conviction
for drinking and driving can have severe consequences. If found guilty of a
drinking and driving related offence, you will have a criminal record, you will
be prohibited from driving for a minimum of one year and you will have to
pay a statutory fine. If you are convicted a second or third time you will face
jail time. The minimum sentence for a second drinking and driving conviction is
fourteen days in jail and the minimum sentence for a third conviction is ninety
days in jail.
If someone is injured or killed as a result of your
drinking and driving, the penalties increase significantly. The Highway
Traffic Act also carries its own separate suspensions and penalties in
addition to the sanctions imposed by the Criminal Code of
Canada. Under the Highway Traffic Act, once you are charged
with a drinking and driving offence, your license is automatically suspended
for ninety day and will not be automatically reinstated once the suspensions
have expired. You will have to take a course and complete the “Back on
Track, Ontario's Remedial Measures Program”.
